Motion Denied AGAIN!!!!  

I'd like to apologise with the delay in advising you of what went on in Parliament on Wednesday 29th October 2008 but to be honest the whole ordeal absolutely gutted me completely. Terry Mills, Dave Tollner, Peter Chandler and Ross Bohiln from the CLP and Gerry Wood from IND all spoke in Parliament..... their words were so heart wrenching and sincere, even I ended in tears (I'm normally a hard person to break). I truly appreciate all of their efforts and it never ceases to amaze me just how much support they have shown and continue to show, not just us but the whole community in general!!!!
No, it didn't go through - the Labour Govt refused to allow this matter to go to a committee to be looked at further. Disgustingly though, only 4 Labour members were present throughout the hour long debate.
What is the most horrific of this is that all of the labour women are part of EMILYS list (a group who help these women (if you can call them that!!!!) get into politics. Their principal value "EMILY's List members and candidates must support in the community, and in Parliament, the principles of equity, diversity, pro-choice, and the provision of equal pay and childcare" - buggered if I can understand what part of what we are asking for isn't "pro-choice" - pretty obvious to me that this is the #1 reason why the women of the Labour party have never been in Parliament in debate time  http://www.emilyslist.org.au/about_us/about_us.asp

When I lost our precious ~Kaden~ I vowed to never give up and I intend to uphold this promise to everyone who needs this change.

Hi everyone My name is Fiona Peters. My Husband, Craig and kids Taylah and Ethan gave birth to our son Kaden Craig John Redriff who was 17 weeks on 26th March 2007. Some of you may know of our story through the media over the past few weeks but for those of you who don't I'd really like to share our story with you in an aim to obtain some public support in helping change legislation in relation to Birth and Death Certificates for babies born pre 20 weeks. Whilst we appreciate that our story may cause memories for parents who have suffered under the current legislation we ask that those parents come forward and support us in the proposed legislation for the future. 

Our Story -: 
Kaden was 17 weeks when he decided to enter this world. St John Ambulance was called when I realised I was in full labour with Kaden. Kaden had already been delivered at home prior to the arrival of St Johns Ambulance at our house. 
Two medics attended, both of whom were very compassionate however constantly apologised for the fact they didn't have anything in the Ambulance to "transport Kaden's body". One of the officers returned with a bed pan, again apologising for not having anything else. Kaden's body was placed in the bed pan and this was then placed inside a yellow "biohazard" bag where Kaden remained until sometime after arriving at the hospital. After being taken by ambulance to Royal Darwin Hospital, with Kaden's body, arriving approx: 12:50am 

I was taken into the Accident and Emergency Department. I first saw a nurse who advised me we had given birth to a boy. Following, we saw a Doctor, a registrar obstetrician, and Obstetrician. After using the same words to all of them "what happens now? What happens to his body" all of them informed us that we "take him home". One even suggested we could always bury him in "the backyard". 

At no time were we given any type of options other than to take him with us. After losing copious amounts of blood whilst the placenta was still inside me the hospital staff decided to give me the injection to bring the placenta away, put me on a saline drip and also put in a drip in readiness for a blood transfusion. The Doctor advised us that if Kaden was 20 weeks there would be a requirement for a funeral however as he wasn't there was no legal requirement. Again we were advised to take him home. Finally the registrar and obstetrician wheeled me to another room. The Obstetrician advised me that they had minutes to get the placenta out or I would need surgery and a blood transfusion. The placenta was removed at approx 3.20am (more than 3 hours after his birth). The Obstetrician gave us the option of an autopsy but also said in his experience that it rarely showed anything up unless we were worried about genes testing. We declined an autopsy. He also advised that he couldn't see anything physically wrong with Kaden. Craig, myself and Kaden's body were left in the room alone whilst the placenta was left on a stainless steel trolley in full view with blood soaked dressings and utensils, a sight which distressed us and added to the grief we were enduring. At no time did anyone offer us any advice as to "what to do next". We weren't offered counselling of any type. Prior to being moved back to the A & E the nurse Kaden on a wet pad/wadding and placed him in a kidney dish and handed him to us. We felt Kaden was treated like a piece of meat and with total disrespect by this action. We both have experienced continual nightmares after enduring such an act. 

At no time did any medical staff weigh or measure him. We are now, and always will be, left wondering what his weight and length were. This negligence has also added to implications of us not being able to obtain a birth certificate for Kaden as the Northern Territory legislation states (as does in all other states in Australia) a birth certificate will be given to a baby of 20 weeks gestation or 400gm. 

We left hospital, at approx 4.50am walking out through the A & E waiting room with Kaden in a green Kidney dish not covered over with anything at all, in full view of all waiting patients to see his body. This was more distressing than I can put into words. We then sat in the carpark for approx 20min in shock, neither of us feeling as though we should have been on that side of the A & E doors, considering the blood loss for me had been quite substantial and the fact that we were leaving to fend for ourselves with no guidance of what to do next. We did not know who to contact or what to do with Kaden's body. 

We came home, not knowing what to do with Kaden's body, rang my mum and Craig's dad who advised us to put him in an enclosed container in the fridge which we did. A friend of mine contacted Sids and Kids who were a tower of strength for us and was horrified at the story so far and advised that she would be having a meeting with the hospital to discuss what had happened. Margaret also went and saw an NT Minister, on our behalf to see what he could do about the chain of events. 

Chaplain Major Andrew McNeill from the Army came to our home, whom performed a small service at home for Kaden and took his body into Simplicity Funerals for us. We were not allowed to put Kaden's name down on the cremation paperwork as he didn't have a birth or death certificate. I was told it had to be the same as the letter from the hospital, which stated "baby of Fiona Peters". There is no Birth or Death Certificate for Kaden because he wasn't deemed 20 weeks and because he wasn't weighed we couldn't prove that he was 400gm even though he was a fully formed baby.

Terry Mills, MLA from Palmerston NT has tabled proposed legislation called "The Kaden Bill". This Bill was tabled 2 weeks ago at the NT sittings however it will not be heard/debated in Parliament until October this year. There is also a member in Queensland who is extremely interested in tabling the same changes there. We would dearly love for other Members around Australia to also take this Bill to their respective Parliaments. The outline of the proposed legislation is to allow parents of baby's born pre 20 weeks gestation the ability to "request " a birth and death certificate within 60 days. The legislation is aimed at empowering the Minister to have authority to direct a birth and/or death certificate to be issued. 
We appreciate the fact that some people would not wish to do this however as it stands at the moment there isn't a choice. This proposed legislation is NOT designed to change the 20 week legislation, but simply to allow parents a choice. 
It needs to be noted that should a baby be born at 19 weeks and 6 days the current legislation also applies to them .
Because of the 60 day time constraint Craig and I probably wont be able to get an official certificate for Kaden as it has now been 23 weeks but we are prepared to continue our fight for the future. The way we see it is things have to change and if we continue to sit back and accept what is inappropriate in this day and age then nothing will ever change.

In reference to the Royal Darwin Hospital, after 9 versions of the policy  to ensure things are in place so that parents will have options other than to take their baby home and covering all issues as pointed out in our statement and 13 weeks of fighting we are proud to say that there is now a firm policy which has been implemented as of 11 September 2007.  Hopefully now no other person will ever endure the horror which we did in any Northern Territory Hospital again.

Please help us in our fight for the future...... ... pass this onto everyone you know requesting them to make comment on the proposed legislation. 

The MISS Foundation and the Missing Angels Bill is an interesting movement in the US lobbying for birth certificates as well as death certificates to be given for stillborn children. This is not directly related to Kaden’s case as all the stillborn children are defined as children lost after the 20th week of pregnancy and were given death certificates but it is relevant in that it shows the pain of parents, the need for legal recognition that their child existed – that the baby was born as well as that it died. It is a different part of the same movement. So far, 19 US states have amended their laws to offer parents a ‘certificate of birth resulting in stillbirth,’ as well as a certificate of death.
